Privacy Policy
This policy explains what personal information we collect when you shop with us, why we collect it, who we disclose it to, how long we keep it and what you can do about it. We handle personal information in line with the Australian Privacy Principles set out in the Privacy Act 1988 (Cth).
1. Who Is Responsible for Your Information
Maria Sydney, 15 Llewellyn St, Oatley NSW 2223, Australia, is responsible for the personal information collected through this website. All privacy enquiries go to info@mariasydney.com.
2. Personal Information We Collect
| Category | What it includes | Why we collect it |
|---|---|---|
| Identity and contact details | Your name and email address | To confirm your order and to reply when you write to us |
| Delivery details | Delivery address, billing address | To send your parcel and to match the payment to the order |
| Order details | What you bought, sizes, colours, the amount paid, the date | To fill the order, to handle returns and refunds, and to keep the records we are required to keep |
| Payment details | Confirmation that a payment succeeded, the payment method type, the last digits of a card | To reconcile orders and to issue refunds to the correct method |
| Correspondence | The content of your emails and contact form messages | To answer you and to keep a record of what was agreed |
| Technical information | Approximate location, device and browser type, pages viewed, referring site | To keep the shop working and to see which pages get used |
We never collect or store your full card number. Card details go directly from the checkout to our payment provider and are never visible to us at any point.
3. How We Collect Personal Information
We collect it in three ways:
- Directly from you, when you place an order, fill in the contact form or send us an email.
- Automatically, through cookies and the analytics built into our shop platform when you browse the site.
- From our providers, when our payment provider confirms a payment or a carrier confirms a delivery.
Where it is lawful and practicable, you can deal with us without identifying yourself, for example when browsing the site. We cannot fill an order without a name and a delivery address.
4. Why We Use Your Information
- To take, pack, ship and track your order.
- To send order confirmations, dispatch notices and tracking.
- To answer your questions and to handle returns, refunds and consumer guarantee claims.
- To detect and prevent fraudulent orders and payment misuse.
- To meet our tax, accounting and consumer law record keeping obligations.
- To understand, in aggregate, which pages people use, so the shop gets better rather than louder.
We do not sell your personal information, and we do not disclose it to anyone for their own marketing purposes.
5. Who We Disclose It To
Only to the providers who make an order possible, and only with what each of them needs to do its part:
| Recipient | What they receive | Why |
|---|---|---|
| Shopify | Order and account data, technical data | They run this shop and store its data |
| Our payment provider | Payment and billing data | To process your payment and any refund |
| Our delivery carrier | Your name, delivery address and a contact detail | To deliver your parcel and to contact you about the delivery |
We may also disclose personal information where we are required or authorised to do so by law, or where it is reasonably necessary to prevent a serious threat to life, health or safety.
6. Information Stored or Processed Outside Australia
Our shop platform and some of our providers operate on servers outside Australia, which can include the United States and Europe. That means your personal information may be stored or processed overseas by them.
We take reasonable steps to use providers that are bound to protect personal information to a standard comparable to the Australian Privacy Principles. You should be aware that once information is held overseas it is also subject to the laws of the country where it is held, and that we cannot control those laws.
7. Cookies and Similar Technologies
This shop sets cookies in your browser. They fall into three groups:
- Essential cookies, which keep your cart and your session working. Without them the checkout does not function.
- Preference cookies, which remember choices such as whether you have dismissed a notice.
- Analytics cookies, which count visits and page views so we can see which pages get used.
You can block or delete cookies through your browser settings. If you block the essential ones, the cart and checkout will stop working, and that is a limitation of how carts work rather than a choice we made.
8. Marketing Communications
Emails about an order you have placed are transactional. We have to send them, and you cannot unsubscribe from them while an order is open.
If you separately give us your email address for updates, that is marketing, it is optional, and you can stop it at any time using the unsubscribe link in any of those emails. We do not add customers to a marketing list automatically because they bought something.
9. How Long We Keep Your Information
- Order records: for as long as we are required to keep them for tax and accounting purposes, and for as long as a return, refund or consumer guarantee claim could still arise from that order.
- Correspondence: for as long as it is relevant to an open matter, and then in our records as evidence of what was agreed.
- Marketing contact details: until you unsubscribe, after which we keep only what is needed to make sure we do not contact you again.
- Technical and analytics data: for the retention period set by our shop platform.
When we no longer need personal information, and we are not required by law to retain it, we destroy it or remove the details that identify you.
10. How We Protect Your Information
This site runs over an encrypted connection. Access to order data is limited to the people who need it to fill orders and answer you. Payment data is handled by our payment provider under their own security controls and is not stored on our side.
No system is completely secure and we do not claim otherwise. If a data breach occurs that is likely to result in serious harm, we will notify you and the Office of the Australian Information Commissioner as the Notifiable Data Breaches scheme requires.
11. Children's Privacy
This shop is intended for adults. We do not knowingly collect personal information from children under 16.
If you believe a child has provided us with personal information, contact us and we will delete it.
12. Accessing and Correcting Your Information
You have the right to ask for a copy of the personal information we hold about you, and to ask us to correct it if it is wrong or out of date.
Email info@mariasydney.com with your request. We respond within a reasonable time and we do not charge for it. We may need to verify who you are before we release anything, which protects you rather than us. If we refuse a request, we will tell you why in writing.
13. Making a Complaint
If you believe we have mishandled your personal information, write to info@mariasydney.com and set out what happened. We will investigate and reply to you in writing.
If our response does not resolve the matter, you can take the complaint to the Office of the Australian Information Commissioner at oaic.gov.au, which is the independent regulator for privacy in Australia.
14. Changes to This Policy
We may update this policy as the shop changes or as the law changes. The current version is always the one published on this page, and the date below tells you when it last changed.
